CAN I ENGAGE IN BUSINESS OR EMPLOYMENT OTHER THAN THE ONE STATED IN THE EMPLOYMENT OR WORK PASS OBTAINED ?

No.

Every Employment or Work Pass issued to any person shall be subject to the condition that during the validity of the pass the holder shall not without the consent in writing of the Immigration Department of Malaysia engage in any form of paid employment or in any business or professional occupation in Malaysia, other than such particular employment, business or professional occupation as specified in such pass.

HOW DO I APPLY FOR AN EMPLOYMENT PASS ?

Before an Employment Pass can be issued, an expatriate post must be approved either by the Expatriate Committee or relevant agencies.

Your application for an Employment Pass may then be submitted together with the following documents :

  • Covering letter
  • Form IMM. 8 (2 copies)
  • Form IMM. 38 (2 copies, if applicable)
  • Form DP 8 (2 copies)
  • Approval letter by relevant agencies
  • Employment contract duly stamped
  • 3 recent photographs of applicant measuring 3.5cm x 5.0cm
  • Photostat copy of Passport or Travel Document

Your application for Employment Pass must be submitted by your employer in Malaysia to the Immigration Department of Malaysia.
