I HAVE MIGRATED TO UNITED STATES AND RENOUNCED OF CITIZENSHIP OF MALAYSIA. CAN I BE REGISTERED AS A CITIZEN OF MALAYSIA AGAIN ?

First you have to obtain a permanent resident status from the Immigration Department of Malaysia.

Thereafter, you can apply after having fulfilled the conditions or requirements to apply for certificate of naturalization in a special circumstances.

Under the Article 18(2) of the Constitution, except with the approval of the Federal Government, no person who has renounced or has been deprived of citizenship or who has renounced or has been deprived of Malaysian citizenship or citizenship of Malaysia before Merdeka Day under the Federation of Malaya Agreement, 1948 shall be registered as a citizen.

I AM A MALAYSIAN CITIZEN BY NATURALIZATION BUT HAVE BEEN AWAY FROM MALAYSIA FOR THREE CONTINUOUS YEARS. AM I STILL A MALAYSIAN CITIZEN ?

Yes, if you have registered annually at a consulate of Malaysia or Malaysian Embassies your intention to retain your citizenship.

However, if you are a citizen of Malaysia by registration or naturalization and the Federal Government is satisfied that you has been ordinarily resident in countries outside Malaysia for a continuos period of 5 years and during that period has neither

  • been at any time in the service of the Malaysia or an international organization of which the Malaysia Government was a member nor
  • registered annually at a consulate of Malaysia your intention to retain your citizenship,

the Federal Government may by order deprive of your citizenship.

Application for registration the intention to retain citizenship, shall be in Form F which can be obtained at any Malaysian Consulate Office.

The application in Form F must be accompanied by the following documents :

  • Identity card of applicant
  • Current travel document of applicant
  • Certificate of citizenship of applicant
  • 1 photograph of applicant
