HOW DO I APPLY FOR A COMPANY SECRETARY LICENSE ?

You have to submit your application and relevant documents and fee to the Registrar of Companies.

You should obtain an application form Form 48C from the Registrar of Companies. Fill in the form accordingly. All forms have to be typed written.

Attach documentary evidence relating to your experience, referee's letter, recent passport size photograph and an application fee of RM50.

You will be required to attend an interview to assess your knowledge in company law matters and company secretarial practices.

A license will be issued to successful applicant and you'll be required to pay RM150 for license fee. The license will be valid for 3 years.

You shall renew your company's secretary license at least 30 days before the expiry of the license. To renew your license, you'll have to submit the renewal application form Form 48C together with a renewal fee of RM50.

ARE THERE ANY REQUIREMENTS IN THE REPORTING OF THE COMPANY FINANCIAL STATEMENTS ?

It is always advisable for your company to comply with the International Accounting Standards in reporting your company financial statements.

The financial statements have to be audited and present a true and fair view of your company's financial state of affairs, results and any changes.

For holding companies, the balance sheet and profit and loss account of the group have to be consolidated.

Only Ringgit Malaysia (RM) currency can be utilized and the company accounts can be prepared in Malay or English language.

The date for preparation of the annual financial statements is not specified. However, majority companies in Malaysia adopt 31st December as it coincide with the tax year.
