WHAT ARE THE CREDITOR'S RIGHTS IN BANKRUPTCY ?

Once a debtor has been adjudged a bankrupt, the creditors are entitled to share in any distribution from the bankruptcy estate according to the priority of their claim.

A creditor can challenge an individual debtor's right to a discharge.

Most unsecured, claims come low in priority scheme and may receive little or nothing.

HOW CAN I CHECK WHETHER MY DEBTOR HAS BEEN ADJUDGE A BANKRUPT ?

You should proceed to the Official Assignee Office or Jabatan Pemegang Harta and obtain a copy of search form from the counter. A copy of the search form costs RM1. Photocopies of the form is also acceptable.

Fill up the form and submit it.

The Official Assignee Office will then forward your request to the head office in Kuala Lumpur where the search will be conducted.

The official result of the search will then be sent to the address provided in the search form.

The fee to conduct a bankruptcy search on a company is RM3 and individual is RM5.
